App Drive Terms of service
Version of 8 October 2026
This is a translation of the Italian Termini di servizio, which are the only binding text. If the two versions differ, the Italian text prevails.
1. Provider and subject
1.1 The App Drive service (the "Service") is provided by Somio S.r.l., with registered office at Via Cadorna 141, 74014 Laterza (TA), Italy, VAT no. IT03403980737, certified e-mail (PEC) somio@pec.poste.it, e-mail tickets@somio.it (the "Provider").
1.2 These Terms of service (the "Terms") govern access to and use of the Service, which lets you publish, host, share and monitor web applications through the iPhone and Android apps and the web version, with the related features for managing organizations, users, teams, permissions, reports and integrations.
1.3 The Service is intended only for businesses, professionals and organizations, which use it in the course of their activity. It is not offered to consumers within the meaning of Italian Legislative Decree 206/2005.
2. Definitions
- Customer: the business, professional or organization that holds an Organization, subscribes to a plan of the Service or uses it during the beta.
- Organization: the space of the Service reserved to a Customer, with its users, teams, platforms, brand and subscription.
- User: the natural person who accesses the Service with an account, at the invitation of an Organization.
- Platform: the web application published, hosted or linked through the Service.
- Content: the Platforms, files, data, texts and any other material uploaded or generated by the Customer and the Users in the Service.
- Partner: the Customer enabled by the Provider to manage Organizations on behalf of its end clients.
3. Access and account
3.1 Access to the Service is by invitation only. The account is created with an invitation code, an e-mail address and a personal password. By signing up, the User accepts these Terms and declares having read the Privacy notice.
3.2 The User must give truthful data, keep their credentials with care and not hand them over to others. Any activity carried out with the User's credentials is deemed attributable to them. Any unauthorized use must be reported without delay to tickets@somio.it.
3.3 The same account may belong to several Organizations, with different roles in each.
4. Organizations, roles and responsibility of the Customer
4.1 The Customer, through its administrators, decides which Users to invite, which Platforms to publish and with whom to share them, and configures integrations, webhooks and optional features.
4.2 The Customer is responsible for the conduct of its Users, for their compliance with these Terms and for the lawfulness of the Content and of the processing of personal data carried out through the Platforms.
4.3 The Customer must inform the users of its Platforms about the data collected through the monitoring, reporting and cloud data features, when turned on.
5. Permitted use
5.1 It is forbidden to use the Service to:
- publish or spread content that is unlawful, defamatory, obscene, discriminatory or infringes the rights of others, including intellectual property rights;
- distribute malware, carry out phishing, spam or unlawful collection of data;
- attempt to access without authorization the accounts, Organizations, systems or data of others, or circumvent the security measures of the Service;
- intentionally overload the infrastructure or compromise the operation of the Service;
- resell or sublicense the Service beyond what is provided for Partners.
5.2 The Provider may remove or make inaccessible Content that breaches this article, informing the Customer, unless prior notice is excluded by legal obligations or urgent security needs.
6. Content and intellectual property
6.1 The Content remains the property of the Customer or of the respective right holders. The Customer grants the Provider a non-exclusive, free license, limited to the duration of the relationship, to host, reproduce, transmit and display the Content to the extent strictly necessary to provide the Service.
6.2 The Service, the software, the App Drive brand and the related documentation belong to the Provider. The Customer is granted a non-exclusive and non-transferable right of use for the duration of the relationship.
6.3 The Customer warrants that it holds the necessary rights to the Content and indemnifies the Provider against third-party claims arising from Content uploaded in breach of these Terms.
7. Personal data
7.1 The processing of personal data is described in the Privacy notice, available at https://drive.somio.cloud/privacy (English translation at https://drive.somio.cloud/en/privacy).
7.2 For the personal data processed on behalf of the Customer, the Provider acts as processor under Art. 28 of Regulation (EU) 2016/679, according to the data processing agreement (DPA), which forms an integral part of these Terms and is available on request at tickets@somio.it.
8. Third-party services and artificial intelligence features
8.1 Some features rely on third-party services turned on by the Customer, including GitHub, Vercel, Netlify, Stripe and Anthropic. Their use is also subject to the terms of the respective providers. The Provider is not liable for the availability or operation of those services.
8.2 The artificial intelligence features (build diagnosis, error analysis, fix proposals) process data only at the User's explicit request and can be turned off by the administrators for the whole Organization. The results are a support tool: the Customer must check them before applying them, in particular before merging a pull request or publishing a new version.
9. Partners and collections from end clients
9.1 The Partner may create and manage Organizations for its end clients, who use the Service under the Partner's responsibility. The Partner warrants that it has informed its end clients about the Service and the processing of their data.
9.2 When enabled, the contracts and collections feature lets the Partner submit contracts and payment requests to its end clients, handled through Stripe Connect. The contractual relationship is exclusively between the Partner and its end client: the Provider is not a party to it, does not guarantee its performance and retains only the fee shown in the "Collections from clients" section.
9.3 The automatic suspension of end clients' access in case of non-payment is a feature made available to the Partner, which remains solely responsible for it towards its clients.
10. Fees, payments and beta
10.1 The fees are those of the chosen plan (Base, Pro or Pay as you go), shown on the site and in the Subscription section, VAT excluded. Payments are handled by Stripe; the Provider has no access to card data.
10.2 Subscriptions renew automatically at the end of each period, unless cancelled from the "Card, invoices and cancellation" section before renewal. The Pay as you go plan is invoiced monthly based on the days of activity of each Platform.
10.3 In case of non-payment, the Provider may suspend the Organization as provided in Art. 13; no data is deleted by the suspension alone.
10.4 During the beta period the Service may be provided free of charge, with evolving features and without guaranteed service levels. The Provider gives at least 30 days' notice of the end of the beta and of the applicable economic conditions.
10.5 The Provider may change prices with at least 30 days' notice; the changes apply from the next billing period and the Customer may withdraw before they take effect.
11. Service levels, maintenance and support
11.1 The Provider takes reasonable measures to ensure the continuity of the Service, without guaranteeing uninterrupted or error-free operation. Scheduled maintenance is, where possible, announced in advance and carried out at times of lower use.
11.2 Support is given by e-mail at tickets@somio.it on working days. Specific service levels may be agreed in writing.
11.3 The Customer must keep a copy of the sources of its Platforms; the Service keeps the latest published versions and rotating backups as stated in the Privacy notice.
12. Limitation of liability
12.1 Except in cases of wilful misconduct or gross negligence, the Provider is not liable for indirect or consequential damages, such as loss of profit, loss of data not due to its breach, business interruption or damage to reputation.
12.2 Except in cases of wilful misconduct or gross negligence, the Provider's total liability for each contract year cannot exceed the amount of the fees actually paid by the Customer in the twelve months before the event; during the free beta, the amount of 500 euros.
12.3 The Provider is not liable for the Content, for the operation of the Customer's Platforms, for the third-party services of Art. 8 or for the relationships between Partners and end clients of Art. 9.
13. Suspension, term, withdrawal and termination
13.1 The contract is for an indefinite term during the beta and, afterwards, lasts for the term of the plan subscribed, with automatic renewal under Art. 10.2.
13.2 The Provider may suspend, in whole or in part, the access of a User or of an Organization in case of non-payment, breach of Arts. 3 and 5, a request from the authorities or a concrete risk to the security of the Service or of third parties, informing the Customer.
13.3 The Customer may withdraw at any time by cancelling the subscription or deleting the account; withdrawal takes effect at the end of the period already paid, without refund of the fees for the current period. The Provider may withdraw with at least 60 days' written notice.
13.4 The Provider may terminate the contract under Art. 1456 of the Italian Civil Code, by written notice, in case of breach of Arts. 5 and 6.3 or of non-payment lasting more than 30 days after the suspension.
13.5 When the relationship ends, the Content is returned on request made within 30 days and then deleted, as provided by the DPA.
